    ¬ Arbitration under offshore tax/financial stability agreements; growing proliferation and use of bilateral investment treaties; investor-state claims; Canada’s recently implemented foreign investment protection agreement with China and remedies for Canadian and Chinese investors;

    ¬ Drafting effective arbitration clauses: choice of arbitrator or institution; choice of law; choice of rules; choice of venue; scope of remedies; award enforcement;

    ¬ Canadian companies’ recent experience with international arbitration: What does the objective data show? - Geographical distribution, subject matter, frequency, duration, satisfaction; and

    ¬ Complex damages claims before arbitrators, including drafting valuation clauses.
